AMENDMENT OF INVESTMENT LICENCE

Pursuant to the Investment Law, the Foreign-Invested Enterprise shall apply for amending Investment Licenses in the following cases:

• Changes of investors or transfer of project.

• Changes of project targets.

• Adjustments of project’s investment capital.

• Changes of project implementation location.

SERVICES FOR CHANGING INVESTMENT LICENSES OF FDI ENTERPRISES

LAWPRO, as the experienced consultant on foreign direct investment, regularly assists clients to conduct the following procedures:

• Amendments of the investment policies or application for investment policies in the projects.

• Amendments of Investment Registration Certificate.

DURATION

The duration for the amendments is 15 working days as prescribed by the laws (excluding the time for amendments and supplements of dossiers) except for case where the amendments is due to the transfer of the entire project or the adjustments of the project implementation targets. These cases shall require evaluation by specialized authority agencies, which results in longer process.

APPLICATION PROCEDURES

• For the projects which are granted under the investment policies, in the event of amendments relating to the investment targets, location, main technologies, increasing or reducing the investment capital over 10% of the total investment capital, implementation duration, changes of investors or conditions for investors (if any), the investment registration agencies shall execute the procedures amending decision of investment policies.

• After being granted the investment policy decision, the investors shall carry out the procedures for amendments of the investment registration certificate.

• In addition, foreign-invested enterprises may also perform procedure to adjust its enterprise registration certificate and other related business license (if necessary).
